LAKE HAVASU CITY, Ariz. -- A man convicted in a 2012 asphyxiation killing in which the victim was bound up with 30 feet of duct tape in his Lake Havasu City home is going to prison for life. The Today's News-Herald reports a Mohave County Superior Court judge sentenced Michael A. Mears on Friday to life with the possibility of parole after 25 years. Judge Derek Carlisle said prosecutors failed to prove that Mears intentionally killed Brett Kelly or that other factors justified life imprisonment at home without parole. Jurors convicted Mears in July of first-degree murder. An attorney for Mears said he plans to appeal the conviction. A county medical examiner testified that Kelly, whose neck was pressed against a couch, died of positional asphyxiation.
